Referral Bonus Terms and Conditions
Becoming a Referrer
Eligibility. You, as a Referrer, must have connected an active gig work account(s) (Uber, Lyft, Doordash, etc), to qualify for the Referral Program reward.
Participants should only use this Referral Program for personal and non-commercial purposes, and the referral link only shared with personal connections that will appreciate receiving these invitations. You will be able to send a Referral Link by adding the referee’s phone number to the Stoovo app referral page.
Compliance with Law. As a Referrer, you agree to comply with all applicable law, including but not limited to the CAN-SPAM Act. Any distribution of your Referral Program link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your Account and exclusion from Stoovo’s Referral Program.
How to Invite Your Friends to Stoovo Under The Referral Program
You will be able to send a Referral Link to friends/family’s phone numbers on your Stoovo app referral page. Subject to the rules of these Referral Terms, you can send a Referral Link to up to 3 friends per month. Referred customers who use your Referral Link are eligible for Referral Rewards (as defined below) that will be sent via gift card or virtual card. For every referred customer that follows the conditions below, you are eligible for a $5 gift card.
Eligibility. Referrers may make a referral by entering a referred customer’s phone number through the app referral page on the Referrer’s Stoovo account. The referred customer must use the Referral link to sign up for a Stoovo account and connect an active gig work account (Uber, Lyft, Doordash etc.) before the referral is deemed a “Qualified Referral.” Both the Referrer and referee are eligible for Referral Rewards. If all these conditions are met and subject to compliance with these Referral Terms, both the Referrer and the referred customer will get Referral rewards as described below.
Exclusion. Note that for a Qualified Referral to be valid, the referred customer: (i) must be a new Stoovo customer and have not had a Stoovo account in the past; (ii) is not the same person as the Referrer (for example, by using a different email address). The Qualified Referral will be associated with the Referrer who provided the referred customer’s email address, phone number, or Referral Link used as part of this promotion.
For each Qualified Referral (as defined above), the Referrer will receive a $5 reward that will be credited via gift card, and the Referred Customer will receive a $5 reward that will also be credited via gift card (each a “Referral Reward”). Referral Rewards will be delivered to recipients via email or SMS, using the platform Tremendous, in the first 5 days of the following month. The Rewards will be available for use through a link sent to the recipient’s email or SMS. Referrers are eligible to receive up to 3 Referral Rewards per month if they make multiple referrals that qualify for Referral Rewards as part of this Referral Program, subject to compliance with the remaining terms.
Referral Rewards will begin July 22nd, 2022. Users will be able to qualify on a first come first serve basis. The total available referral links between all users is 1,000. Once the referral link pool is exhausted, the Referral Rewards will close.
Representations and Warranties
You represent and warrant that you: (i) will not hold itself out as an agent or otherwise purport to represent or bind Stoovo in any manner; (ii) will not make false or misleading representations with regard to Stoovo services; (ii) will not make representations, warranties, guarantees or negotiate any specific terms with Referred customers including, without limitation, with respect to the specifications, features or capabilities of Stoovo’s services; and (iii) shall not under any circumstance disparage Stoovo, its products or services.
You acknowledge and agree that Stoovo’s Referral Program is not intended for and cannot be used by businesses or individuals for affiliate lead generation and that (Referral Links cannot be posted on discount websites). Both you and the referred customer must be eligible to use Stoovo’s services to be eligible for the Referral Program. The Referral Program is only available for US-based customers.
Referred Stoovo Accounts may not combine any other offer codes or other promotions offered by Stoovo unless specified by Stoovo.
Multiple Referrals. A referred customer may only use one Referral Link. If a referred customer receives Referral Links from multiple Stoovo customers, the referred customer may only use one Referral Link and obtain one Referral Credit.
Existing customers. Existing customers cannot send Referral Links to themselves (for example, you are not permitted to use a different email address to send a Referral Link to yourself). Sending yourself a Referral Link and using that Referral Link to receive a Referral Credit on your Account (or a new Account that is linked to the same person) is prohibited and a violation of these Referral Terms.
Applicable Laws. You agree to comply with all applicable laws, including but not limited to the CAN-SPAM Act in connection with using the Services and participating in this Referral Program. Any distribution of your Referral Link that could constitute unsolicited commercial email or “spam” under any applicable law is expressly prohibited and will be grounds for immediate termination of your Account, exclusion from Referral Program, and forfeiture of any Referral Rewards in your Account. This includes mass emailing, texting, or messaging people you do not know, or using automated systems or bots to distribute your Referral Link.
You will defend, indemnify and hold harmless Stoovo, its affiliates, directors, officers, and employees against all liabilities, damages, losses, costs, fees (including legal fees), and expenses relating to any allegation or third-party legal proceeding to the extent arising out of: (a) Your participation in the Referral Program; (b) Stoovo’s use of any Your content (provided that such use complies with the requirements of the Terms of Service); and (c) Your breach of any representation or warranty in these Referral Terms.
LIMITATION OF LIABILITY
IN NO EVENT SHALL STOOVO BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION (INCLUDING NEGLIGENCE), WHETHER OR NOT FORESEEABLE.
If any provision in these Referral Terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void, or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.
Right to Terminate Accounts
Stoovo may suspend or terminate the Referral Program or your ability to participate in the Referral Program at any time for any or no reason. We reserve the right to suspend any Referrer and/or referred customer’s account if we notice any activity that we believe is abusive, fraudulent, or in violation of the Terms, including these Referral Terms. We reserve the right to review and investigate all referral activities in our sole discretion as deemed fair and appropriate. Subject to applicable laws, if the Referral Program is terminated, any unclaimed Referral Rewards will be forfeited at that time.
Right to Cancel Referral Program or Change Terms
Stoovo reserves the right to cancel the Referral Program or to revise these Terms at any time, at our sole discretion. If we do so, we’ll let you know either by posting the updated Referral Terms to the Stoovo help center, by sending you an e-mail, or through other communications. It’s important that you review these Referral Terms whenever we update them. If you continue to participate in the Referral Program after we have posted updated Referral Terms, you are agreeing to be bound by the updated Referral Terms. If you don’t agree to be bound by the updated Referral Terms, then you may not participate in the Referral Program anymore. Should the Referral Program be terminated, any unclaimed Referral Credit will be forfeited at that time.
If, for any reason, you believe that there is a discrepancy regarding your Referral Rewards balance, please contact us at email@example.com. All decisions regarding Referral Credit balances will be final and at Stoovo’s sole discretion.
